Terms of Use

These Terms govern your use of the Geared Like A Machine LLC website at gearedlikeamachine.com, including the public estimate and scope tools. They are lighter than a production services agreement: a signed agreement governs any actual production work. Equipment rentals have their own terms, linked below.

1. Acceptance of These Terms

By accessing or using gearedlikeamachine.com (the "Site"), you agree to these Terms of Use on behalf of yourself and any organization you represent. If you do not agree, do not use the Site. These Terms govern the Site and its public tools. Equipment rentals are governed by the separate Equipment Rental Terms, and your information is handled under our Privacy Policy, both linked at the end of these Terms.

2. Permitted Use of the Site

You may use the Site for lawful purposes: to learn about Geared Like A Machine LLC ("GLM"), to view our work, to read the blog, to request rental quotes and project estimates, and to start a project conversation. You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its normal operation, scraping or harvesting data at scale, introducing malicious code, or using the Site to violate any law or the rights of any third party.

3. Intellectual Property

The Site and its content, including text, graphics, logos, photography, video, layout, and the GLM name and marks, are owned by GLM or its licensors and are protected by intellectual property laws. You may view and share the content for your own informational use. You may not copy, reproduce, republish, sell, or create derivative works from the Site or its content for commercial purposes without GLM's prior written permission.

4. User Submissions

When you submit information through a form on the Site, including the discovery form, the contact form, and the scope and estimate tools, you confirm that the information is accurate and that you have the right to share it. You grant GLM permission to use your submission to respond to you, prepare estimates, and manage the resulting relationship. Do not submit anything confidential that you do not want GLM to receive, and do not submit content that infringes the rights of others or violates any law. How we handle the personal information in your submission is described in our Privacy Policy.

5. Estimates and AI-Assisted Tools

The Site offers tools that use automated and AI-assisted methods to generate estimates, ranges, and other informational output. These outputs are preliminary and informational only. They are not fixed-price quotes, binding offers, or professional advice, and they may be inaccurate or incomplete. Final pricing, scope, and terms for any production are set only by a signed agreement between you and GLM. You are responsible for reviewing any output before relying on it.

6. No Warranty

The Site and all of its content and tools are provided "as is" and "as available," without warranty of any kind, express or implied. GLM does not warrant that the Site will be uninterrupted, error-free, or secure, or that any estimate, figure, or other output is accurate, current, or fit for a particular purpose. To the fullest extent permitted by law, GLM disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

To the fullest extent permitted by law, GLM and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of, or inability to use, the Site or its tools, even if GLM has been advised of the possibility of such damages. GLM's total liability for any claim arising out of these Terms or the Site will not exceed one hundred US dollars ($100). Nothing in these Terms limits liability that cannot be limited under applicable law.

8. Third-Party Links

The Site may link to third-party websites or services that GLM does not control. GLM is not responsible for the content, policies, or practices of those third parties. Following an external link is at your own risk, and the third party's own terms and privacy policy will govern your use of its service.

9. Changes to the Site and These Terms

GLM may modify or discontinue any part of the Site at any time. GLM may also update these Terms from time to time. Changes take effect when posted on this page with an updated effective date. Your continued use of the Site after a change means you accept the updated Terms.

10. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. You and GLM agree that the exclusive venue for any dispute arising out of or related to these Terms or the Site is the state or federal courts located in Dallas County, Texas, and you consent to the personal jurisdiction of those courts.
